Well done on winning. Can i ask did you take this photo yourself or was it taken by Ian Goodwin? as he sent in the same photo to a bbc local website. I thought in this competition you were supposed to submit photos you had taken personally rather than someone elses work, my mistake?

No i did not take this photo myself i just put it on the site as i thought alot my like to see it i did not realise i was breaking any rules

Hi Eve, we liked your picture very much. It cheered us all up and made us smile, and reminded us of that terrible cold winter. It was supposed to be your own picture, but don't worry this time, we'll make it clearer in our terms & conditions next time. All the best, Jenny

I appreciate your honesty eve and yes it did have the photographers name in the title of the photo as you rightly say.

However its not really fair to submit other peoples photos, otherwise everyone may as well do that and not bother taking their own, 60+ would end up with a magnificent gallery of photo's albeit all stolen.

But apart from anything else, there are actually legal implications to using someone elses photo without permission. Any photo taken by a photographer is his own work by right and may not be reproduced without his or her permission, its protected by copywrite.

There is a chap called David Itzcovitz - i dont know if he is related to Jenny or not but it seems likely??- advertising on 60+ who is a Professional Photographer and could probably better explain the situation as regards using photos taken by others without getting permission first where necessary, although there are some exceptions in certain circumstances i think (photos in the 'public domain' or where copywrite has been waived etc).

I say all this for purposes of information which people might find helpful or useful to remember.

Hi all, we are very sorry about the misunderstanding with the Competition and don't want to disappoint any of our readers, so we will be awarding Eve three bottles of wine, and choosing another winner in the next few days, who will also win three bottles of wine. Kind regards Jenny & Murray, Sixtyplusurfers
